In this society, â€Å"social and political contexts emerged that molded speech into certain conventional forms shaped by the psychology and expectation of audiences.† As the need for rhetoric in ancient Greek society immediately became evident, many philosophers offered their theories. Plato (427-347 BCE) discussed rhetoric in several of his works, including Apology and Gorgias. In Apology, Plato describ es rhetoric as dangerous and implicitly deceptive and dishonest. In his protagonists’ opening statement of defense to the judge and jury, Socrates notes that rhetoric employed by his accusers was, while impressively eloquent, not truthful. Plato elaborates on his theory that rhetoric is merely a tool by which any trained or naturally intelligent person can trick any other person. To Plato, rhetoric is a device used for evil and vice. He goes on to suggest that rhetoric masks the truth with flowery language, literary devices, manipulative emotional appeal, and deceptive psychological implications. Plato seems to believe that intellectual discourse sans emotion was more productive of the truth than rhetoric, which naturally incorporated emotion, could ever prove to be. Similarly, in Gorgias, Plato again warns about the dangers of rhetoric; however, in Gorgias, Plato acknowledges the astounding amount of power in the mastery and correct implementation of rhetoric. In Gorgias, wh en a student of rhetoric inquires about the scope of its power, the teacher responds thgat rhetoric â€Å"embracesall the other arts!† He goes on to say, â€Å"the rhetorician is capable of speaking against everyone else and on any subject . . . in such a way that he can win over vast multitudes to anything, in a word, that he may desire.† Plato’s character recognizes the power of rhetoric and allows its use with the stipulation that â€Å"one should . . . make use of rhetoric in the same way as one does of every other sort of proficiency . . . This, one should not employ against any and everybody.† Thus, Plato views rhetoric itself as morally neutral; rhetoric’s potential for evil lies in the intent of the rhetorician. However, on the basis that rhetoric does offer such potential for evil, it should be uses minimally and with extreme discretion on the parts of both the orator and the audience. Perhaps Plato’s cautious approach to rhetoric c ould be explained by his limited usage of it. Plato only discussed rhetoric’s place in judicial affairs. Plato’s belief that rhetoric masked the facts was based on the presumption that â€Å"the facts† were the desired end. He did not consider other situations in which rhetoric could be useful, such as deliberation and encomium. Plato’s limited view of rhetoric influenced Aristotle’s theory to an extent; however, Aristotle expanded greatly on Plato’s theory. The views of other philosophers, such as Isocrates, also contributed to Aristotle’s more moderate view of the tool’s potential. Isocrates (436-338 BCE) had a divergent theory of rhetoric. Isocrates taught rhetoric with the intention of producing noble civic leaders. To Isocrates, â€Å"Rhetoricwas a powerful tool for investigating [immediate practical] problems–where only probable, not certain, knowledge was available† Isocrates advocates obtaining knowledge o f rhetoric for the purpose of creating a functioning society operated by honest, virtuous statesmen who would use their knowledge of rhetoric for the advancement of mankind as a whole. He expresses this belief when he says â€Å"we should not be able to live with one another† without persuasion and self-expression. Isocrates perceives the sphere of influence constructed through rhetoric in a much more optimistic way that Plato. This optimism is derived from Isocrates’ confidence that men would use it for ethical, noble purposes. In one of his many theses, Isocrates states â€Å"The man who wishes to persuade people will not be negligent as to the matter of the character [He] will apply himself above all to establish a most honorable name amongst his fellow citizens.† Also dissimilar to Plato’s theory of rhetoric was Isocrates’ use of artistic modes of language, such as his extensive use of similes and metaphors and even incorporation of audible rhy thm that worked in conjunction with the tone or meaning of his work Also, Isocrates wrote about the systematic construction of a speech. He specifies that a speech must â€Å"have a head (introduction), torso (substantial argument), and feet (conclusion).† As a contemporary of both Plato and Isocrates, Aristotle had the unique opportunity to learn from both men and construct his own theory of rhetoric incorporating selected elements of each philosopher’s theory. For example, Aristotle clearly borrowed from Plato his theory that rhetoric is morally neutral. In his theory, Aristotle emphasizes the duality of every situation. Aristotle notes that rhetoric, unlike any other art, â€Å"reasons in opposite directions† and is â€Å"equally concerned in opposite directions.† In other words, rhetoric has the potential to serve opposite sides of a single situation with equal proficiency. It was out of this truth that Plato found reason for concern. However, Aristot le was not so concerned about the potential misuse of rhetoric. Aristotle dealt quite a bit more with the nature of rhetoric as opposed to the nature of the rhetorician. To Aristotle, as long as a person understood the available means of persuasion in rhetoric, he or she could identify the evil in it and thus not be vulnerable to deception. For example, in a case in which a person is tricked through rhetoric used for evil, Aristotle believed it was a success on the part of the rhetorician at employing the various techniques outlined in Rhetoric and a failure on the part of the audience at not fully comprehending rhetoric. Isocrates’ theory of rhetoric lent more to Aristotle’s theory than Plato’s likely did. While Plato limited rhetoric to the court room, Aristotle expanded it to all realms of life. Like Isocrates, Aristotle discussed the various parts of a speech including a clear statement of the subject and a subsequent demonstration of it. Also like Isocrates , Aristotle strongly advocated any available language devices to appeal to a wide variety of audiences. For example, Aristotle advises rhetoricians to supplant euphemisms for offensive words in order to keep the audience content. He says, â€Å"[when praising] one should always take each of the attendant terms in the best sense; for example, [one should call] an irascible and excitable person â€Å"straightforward† and an arrogant person â€Å"high-minded.† Plato would have likely thought this to be deceptive, while Isocrates would have likely thought it to be clever. Aristotle’s theory of rhetoric incorporated many ideas from the previous theories, but it also introduced new and insightful ideas that seem to be more plausible and certainly more applicable to contemporary rhetoric. This discussion will encompass not only the current state of the law, but also proposals for reform, such as an amendment to the Copyright Act to protect fashion works. The central question is whether fashion design is an art worthy of protection or a craft whose practitioners can freely copy one another. In an industry where many designers come out with similar looks each season and where inspiration is said to be in the air designers and the thriving knockoff industry are fiercely debating the issue. Another key question: whether knockoffs actually benefit the industry as a whole. Copying, some argue, propels the fashion cycle forward by creating popular trends that encourage designers to move on to the next big idea. In what they call the piracy paradox, law professors Kal Raustiala of the University of California, Los Angeles, and Christopher Sprigman of the University of Virginia argue that copying makes trends drench the market quickly, driving the fashion cognoscenti to search out newer looks. If copying were illegal, the fashion cycle would occur very slowly, if at all, While they admit copying can harm individual designers, they say Congress should protect industries only when piracy stymies rather than encourages innovation. Such a test would to a great extent improve the odds that works of fashion would be ranted copyright protection, as most fashion designers are concerned with the aesthetic rather than the functional aspects of their clothing. The specific extension of copyright to fashion works would have many advantages for designers. First, a copyright owner may seek an injunctive remedy to prevent the impersonator of his or her design from making and selling copies of the original. Second , copyright law allows for the imposing and discarding of the infringing items. Third, the copyright owner can recover damages, either actual or statutory, and also profits. Finally, the copyright owner may be able to recover court costs and attorneys fees. This last remedy is especially important in fashion design cases, as it allows small new designers to take on big manufacturers whose greater power and financial resources would otherwise be an intractable obstacle. Despite these advantages to fashion designers, an amendment to the Copyright Act for works of fashion is not likely to be passed soon. As one commentator concisely stated that the current situation of the legislators and courts has a great deal of trouble seeing past the utilitarian function of a piece of clothing. While industrial designs have been the subject of repeated bills, Congress has explicitly excluded fashion works from these bills. For example, while the Design Anti-Piracy Act of 1989 would have protected original designs of useful articles against unauthorized copying, the bill would have barred apparel designs composed of three-dimensional shapes and surfaces with respect to apparel. According to one commentator, this exclusion has no basis in any discernible principle. It was added to help still the vociferous opposition of retailers to the bill. In this current climate of judicial and legislative hostility, copyright protection will probably not be extended to specifically protect fashion works. This Challenger explosion was one of the major catastrophes of the entire Space Program since the beginning of funding for the Space Program was started. It seems, out of all the mistakes that NASA and the United States government has ever made, this one made a lasting impression on many Americans, and foreign authority figures all over the world. The Space Shuttle Challenger disaster was a major tragedy. However, it was a tragedy that could have been prevented with a closer inspection of one of the shuttle's parts that had been of concern since the entire Space Shuttle Program had been started; the O-Ring. Inside the Solid Rocket Booster, there exists certain seals which were the rubber O-rings. The objective of the O-rings is to act as a seal that is meant to prevent gases from escaping through the Solid Rocket Booster. One of the main reasons for the explosion was that O-ring "flexed" and let the gases escape, which in less than seconds later, caught fire and created the explosion. Among the other minor problems were those of electrical problems and faulty gages which were just "overlooked" because the problems were only minor and they posed no real threat to the safety of the mission or the crew of seven(7). 11:39:17am, Tuesday, January 28th, 1986. As the Space Shuttle Challenger soared into the sky that morning, 74 seconds into flight, it exploded, killing all 7 crew members on board including one High-School teacher. This was the worst accident in the history of the U.S. Space Program. It was witnessed by thousands of spectators and visitors who watched at the Space Shuttle Challenger exploded before their eyes. Among the crew killed were: Francis R. Scobee, Commander; Michael J. Smith, Pilot; Judith A. Resnick, Electrical Engineer; Ellison S. Onizuka, Engineer; Ronald E. McNair, Physicist; Gregory R. As the spectators at Kennedy Space Center watched, everyone was in disbelief including many of the technicians inside the control room communicating with Francis Scobee, the Commander of the Shuttle Challenger. This experience is best described through a passage between Challenger and the Control Room which occurred as this: "Challenger lifted off...and passed Mach One, the speed of sound, at 19,000 feet. The computers throttled back the three main engines to 65 percent of thrust, anticipating the stress that the engineers call Max-Q, maximum aerodynamic pressure. 'Okay, we're throttling down,' Scobee reassured his crew as the thrust dropped. For fourteen seconds they swayed and jolted silently in their seats while the shuttle chopped through wind shear. 'Throttling up', Scobee called, watching the bright lines of his flight data screen. 'Throttle up', Smith confirmed from his own instruments 'Roger', Dick Scobee formally acknowledged. 'Feel that mother go', Smith called, noting the violent surge of power. As the Challenger climbed, its computers processed millions of bits of data, sifting, sorting, and sending it down to the Cape where it was instantly re- transmitted to the Mission Control Room at Johnson Space Center in Texas. Inside the control room, the technicians saw that the Challenger's engines had returned normally to full thrust, and that the ascent was proceeding perfectly. As explained in detail by Hays (2001), analysis of Public policy debates began by John Kingdon (1984) and reissued in 1995. Kingdon critically examined how specific policies problems solutions become prominent. Looking at the policy making process, Kingdon particularly concentrated on the prediction stage and agenda setting ignoring the politics of how policy choices are made. He argued that many individual through their own means may call for attention on a particular policy issue that need to be changed but at the end of the day it is a group of elected experts whom he called policy community who make decision on the issue to be the first agenda item therefore providing the ground for new policies (Hays, 2001). The communities operate as resources but also as gatekeepers. Kingdon argued that collectively a range of individuals serve to make up the necessary policy community or networks including experts, elected officials, bureaucrats, researchers and even government itself. As a gate keeper, policy community or networks have a role in informal communication between those inside and the one outside the government. In order to be effective, public policy institutes must be objective to survive in community policy ideas. Solutions in most cases chase problems and that is to say people with solutions will look for the specific problems to solve (Mintrom, 2000). In addition, such institutions must be not only feasible but also compatible with the values of the majority of specialist in policy communities. Alteration of ideas and efforts by the policy advocate to persuade others according to Kingdon is one way of achieving compatibility (Hays, 2001).

Yet So Colorful To truly understand why gay marriage is a pressing issue, understanding both arguments is a must. The argument across the nation is, are you for or against allowing legally recognized marriage between homosexuals to co-exist with that of heterosexual marriages? Yet should same sex marriage be legalized throughout the entire United States? It is a topic of great disagreement among many people, and is discussed in many presidential debates. Tolerance is a word that should be used in all three of our writings, yet for this neutral approach towards same sex marriage tolerance is a perfect word. A definition of tolerance is: The ability or willingness to tolerate something, in particular the existence of opinions or behavior that one does not necessarily agree with. (New Oxford American Dictionary; New York 2001). In this case, tolerance would refer to being tolerant towards those who are for same sex marriage and those who are against same sex marriage. Tolerance is one of the most basic reasons people have immigrated to the United States. Equality and tolerance are needed, for it is our birthright as Americans. Tolerance is a word that is used in The Constitution, The Declaration of Independence, The Gettysburg Address, and Martin Luther King’s famous speech. As much as I am emotionally supportive of same sex marriage, I do believe that as Americans we must give everyone the freedom to believe what they wish, as long as it is not hurting anyone. Therefore those who disagree with same sex marriage have as much right to disagree with gay marriage as those who are for gay marriage or wish to marry some one of the same sex. Tolerance and equal rights are two major reasons so many immigrants from all over the world selected the United States for their home. He states that the creation and development of the next generation is at stake with same sex couples. On the other side of the spectrum gay rights activists argue that marriage should be universal with no boundaries. Gay people (men and men and women and women) should have the same ability to marry just like their heterosexual counterparts men and women. Many gay people claim that not allowing gays to marry is a hate crime. They say it is exactly the same as discriminating against race or religious preference. Thomas Jefferson uses the Declaration of Independence to elaborate on the rights of a government. His idea of equality is closely related to the concept that, because all men are equal, the government’s power is based on â€Å"the consent of the governed,† not by its own arbitrary whims or motives. Today, America is one of the most culturally diverse nations in the world. Given this, the importance of tolerance in the government has great importance at present. The Massachusetts Supreme Court ruled that a ban on gay marriage was unconstitutional, and in the opinion stated that: â€Å"government attorneys failed to identify any constitutionally adequate reason to deny them [gay couples] the right. † This was a very important and groundbreaking ruling. It opened the doors for more states to legalize same sex marriage. It is important for heterosexual people to be tolerant towards homosexuals and their legal right to ask for same sex marriage. It is also important for gay people to respect, be patient and tolerant of heterosexual that do not believe in same sex marriage. Dowling Engl. 100 The Wrong Choice, Vote Yes For the Two thousand years of this countries rich history, homosexuality was considered a sin and bad enough to ban, with many state laws prohibiting sodomy. Then in the 2003 Lawrence VS Texas case, The Supreme court ruled in favor of homosexuality and for the laws to be taken away. As the article I read stated, suddenly, homosexuality was not bad enough to prohibit and now, we have to permit it. Homosexuality is bad for the economy and the people of the United States of America and it should be against the law to act in a homosexual manner. My first argument is that a child a gay couple raises may grow up to be shunned by others even in fact alienated by the society they live in. Gay couples raising children cannot give or meet the child’s needs that many heterosexual couples can. Children feel alienated or embarrassed when in public with their homosexual parents. Many homosexual relationships end very badly. Homosexual relationships have a higher break up rate or â€Å"divorce† rate than heterosexual couples. These couples indoctrinate their children from day one on this earth by accepting homosexual relationships as equivalent and the norm. Further more adoption in the homosexual relationship will make the child a trophy, which in effect, validates homosexual relationships. Allowing same sex marriage validates homosexual relationships. My second point is that of taxes, taxes kill me on a day-to-day basis, and I am sure I am not alone. Income taxes will increase in order to make up for the marriage tax benefits given to homosexual couples. As well as paying for social costs resulting from illegitimacy increases. Do you believe Homosexual couples should get the same benefits from raising a child as a man and women raising a child should? Further more social security taxes would increase in order to pay enefits of losing a significant other, such as â€Å"widows† and â€Å"widowers†. Not to mention medical insurance premiums will be at an all time high if gay marriage is allowed because we have to offset the health care costs that go along with homosexual behavior such as (AIDS, hepatitis, Colon Cancer, and other diseases) these homosexual acts will likely be more validated and will likely increase if same sex marriage is approved. Homosexual supporters may say, â€Å"It isn’t hurting anyone† When in theory it is hurting everyone. They could also say something along the lines of â€Å" If I want to behave a certain way, it is my right† when It may be your right, but that does not mean society as a whole is going to endorse and support your choices. Homosexuality will tear this country apart. Hurting our generations to come by indoctrinating our children and our children’s children, but also hurt you and our country as a whole. Dowling Engl. 100 Gay Marriage: A 21st Century Prejudice Isn’t it good for society to have couples that are in love and are committed to one another regardless of sexual orientation? Furthermore people who love one another create good in there own lives and for people around them. For example I have had the rare opportunity to have two gay couples in my family. My great uncle Bill and his boyfriend uncle Paul were in love and together for over 40 years. They were monogamous and married in their hearts and minds for over 40 years. They taught my siblings, my cousins and I how to sail, cook and love your partner unconditionally through the good times and the bad times. They could never legally be married. The unfortunate consequence of the two never being able to marry occurred when my uncle Bill died this year. Our uncle Paul is unable to support himself because unlike a wife he cannot receive his partner social security benefits and veteran health insurance benefits even though he cared for our uncle Bill for 10 years when he was a quadriplegic. Another example is my step cousin Sylvia and her partner Katherine. They have been together for 20 years. They live in Vermont. They were able to get married. They now have 2 children. Katherine and Sylvia are protected legally and financially through their marriage. They love each other and are committed to being each other’s spouse and being loving parents to their two heterosexual children. They love their children and will support their daughter and son to be the best citizens they can be. Their sexual preference is unimportant. These couples are two examples of how same-sex marriage can be successful. So is necessary to protect the partner if death or illness occurs. For example if a gay person is hospitalized and they are not married to their partner. Their partner is not allowed in the hospital room because they are not family. If their partner dies and they are not married they cannot receive their partners social security benefits but a legal spouse can receive their husband or wife’s benefits. This unequal playing field is sad and emotionally unappealing. With the divorce rate being over 60% and with the suicide rate being so high there should be absolutely no shame or judgment in being with the person you truly love. I might sound like a romanticist yet it may make the world a happier place with everyone being so equal and on the same ground, giving way for more tolerance and love to be expressed.
